Terms of Service

1. Agreement

By creating an account or using Bustani ERP ("the Service") you agree to these Terms of Service. If you are accepting on behalf of a Rotary club or other organisation, you confirm that you have authority to bind that organisation.

2. The Service

Bustani provides cloud-based software to manage members, dues, donations, projects, meetings, and communications for service organisations. Features available depend on your subscription plan and may change as the Service evolves.

3. Accounts and access

  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • Each club is responsible for assigning roles to its administrators, members, and committee leaders.
  • You must notify us promptly of any unauthorised access or suspected breach.

4. Subscriptions and payments

Paid plans are billed in advance on a monthly or annual basis. Payments are processed by Stripe (cards) or Safaricom M-Pesa (mobile money). All fees are stated exclusive of applicable taxes.

If a payment fails we will retry and notify the account owner. Persistent non-payment may result in the plan being downgraded or access being suspended.

5. Refunds and cancellation

You may cancel a subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for partial periods unless required by law.

Donations collected from your donors and held on your behalf are remitted to your nominated account on the payout schedule shown in the dashboard, less applicable processor fees.

6. Your data

Your club's data — member records, donations, projects, documents — remains yours. You can export it at any time. We process it on your behalf as described in our Privacy Policy.

On account closure your data is retained for 30 days, then deleted, except for financial records which we retain for the period required by Kenyan tax law.

7. Acceptable use

You agree not to:

  • Use the Service to send unsolicited bulk messages or spam.
  • Upload content that is unlawful, infringing, defamatory, or that violates anyone's privacy.
  • Attempt to probe, scan, or compromise the security of the Service or its hosting infrastructure.
  • Reverse engineer the Service or build a competing product from its outputs.
  • Use the Service to launder funds or to disguise the origin of donations.

8. Third-party services

The Service integrates with Stripe, Safaricom M-Pesa, and other providers. Your use of those integrations is also subject to the providers' own terms. We are not responsible for outages, fees, or policy changes from those providers.

9. Warranties and disclaimers

The Service is provided "as is". While we work hard to keep it reliable and secure, we do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose beyond what is documented.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect or consequential losses, including lost donations, lost members, or reputational harm.

11. Termination

We may suspend or terminate accounts that violate these Terms or that pose a risk to other users or to the Service. Where practical we will give notice and an opportunity to resolve the issue.

12. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced in-app and by email at least 14 days before they take effect.

13. Governing law

These Terms are governed by the laws of Kenya. Any dispute will be resolved in the courts of Nairobi unless otherwise required by mandatory consumer protection law in your country.
